1. Agreement to Terms
Welcome to BlackStream Group. These Terms of Service (“Terms”) govern your access to and use of our website (https://blackstreamgroup.com) (the “Site”) and our funding services (the “Services”). By accessing the Site or using the Services, you agree to these Terms. If you do not agree, please do not use our Site or Services.
2. Eligibility
You represent and warrant that:
- You are at least 18 years old and legally capable of entering into binding contracts.
- You are authorised to act on behalf of any business entity you represent.
- The information you provide to us is accurate, complete and not misleading.
3. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Engage in any unlawful conduct or infringe others’ rights.
- Use the Site in a way that could damage, disable or impair it.
- Attempt to gain unauthorized access to any part of the Site.
4. Funding Services
4.1 Application and Matching: When you apply for funding via our Services, we will collect and evaluate your information and match you with appropriate funding options via our network.
4.2 No Guarantee of Funding: Submission of an application does not guarantee approval. Final funding decisions are made by the lenders or funding providers.
4.3 Independent Providers: We may act as an intermediary or broker connecting you with third-party lenders; your agreement may be directly with the funding provider.
4.4 Fees and Terms: You agree to any fee structures or terms defined in your separate funding agreement with the provider (or with us, where applicable). You must review and agree to those terms before any funding commitment.
5. Account Information
If you create an account or profile, you are responsible for maintaining the confidentiality of your credentials, and for all activities under your account. You must promptly notify us of any unauthorized access or breach.
6. Intellectual Property
All content on the Site (text, graphics, logos, images, software) is owned or licensed by us and is protected by copyright, trademark and other laws. You may view and download content for your personal/business use only, not for re-distribution, modification or commercial use unless expressly permitted.
7. Disclaimers
The Site and Services are provided “as is” and “as available.” We do not make any representations or warranties of any kind (express or implied) regarding the accuracy, completeness or suitability of the information or Services. We exclude (to the extent permitted by law) all warranties, including implied warranties of merchantability or fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, neither BlackStream Group nor its affiliates, officers, employees or agents will be liable for (i) any indirect, consequential, incidental or punitive damages, (ii) loss of profits, revenue, business interruption or data, (iii) any monies owed or lost through use of the Site or Services — even if we have been advised of the possibility of such damages. Our total liability for any claim under these Terms shall not exceed the amount you paid to us for the Services in the preceding twelve months (or in the absence of fees, one hundred dollars (US$100)).
9. Indemnification
You agree to defend, indemnify and hold harmless BlackStream Group and its affiliates, officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses and expenses (including legal fees) arising from or relating to your:
- Use of the Site or Services,
- Violation of these Terms,
- Violation of any law or third-party rights,
- Inaccurate or incomplete data you provided.
10. Modifications to Terms
We may revise these Terms at any time by posting the revised version on the Site and updating the “Effective date.” Your continued use of the Site or Services after changes means you accept the updated Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey (or another state as appropriate). Any dispute arising out of or relating to these Terms or your use of the Site/Services shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey (or the state you specify).
12. Severability
If any part of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.
